Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the CSPI application and related services (“App”). By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1) Who we are

The App is provided by CSPI (Pty) Ltd (“we”, “us”, “our”), incorporated in the Republic of South Africa (Reg. No: TBC, VAT: N/A). Registered office: TBC, South Africa. Website: https://cspi-app.co.za. Contact: support@cspi.app.

2) Eligibility

You must be 18+ and have capacity to contract under South African law. The App is not intended for children without verified guardian consent. You warrant that your details are accurate and kept current.

3) Accounts & Security

  • You are responsible for your account, device, and safeguarding credentials.
  • Notify us at support@cspi.app of suspected unauthorised access.
  • We may suspend or terminate accounts to protect users, investigate abuse, or comply with law.

4) Purpose of the App

The App enables collection of survey data for research and insights. We may analyse results internally and (as detailed below) collaborate with trusted partners for further analysis. The App does not provide financial, medical, or legal advice.

5) No Fees & No Billing

We do not charge for use of the App. There are no subscriptions, purchases, or paid features, and therefore no renewals, cancellations, or refunds apply.

6) Data We Collect

  • Survey Responses: answers you submit, which may include optional demographic information (as indicated within the survey).
  • Technical Data: device, app version, and usage information necessary to operate and secure the App (e.g., timestamps, crash logs).
  • Contact Details (optional): if you choose to provide a name, email, or cell number for support or follow-up, we store these separately from survey responses where practicable.

7) Data Sharing & De-identification

We may share survey datasets with third parties strictly for analysis or research (e.g., research institutions, analytics vendors, academic partners). We do not share the following direct identifiers with those partners: name, cell number, email address, ID number.

  • Where feasible, we de-identify or aggregate survey data before sharing.
  • Partners are contractually required to use the data only for agreed analysis and to apply appropriate security safeguards.
  • We do not sell personal information.

8) Privacy & POPIA

We process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and our Privacy Policy. By using the App and submitting surveys, you consent to such processing as described here and in the Privacy Policy.

9) Security

  • Encryption in transit (TLS) and security controls appropriate to the sensitivity of data.
  • Restricted access on a need-to-know basis; audit and monitoring where reasonable.
  • Separate storage of direct identifiers from survey responses where practicable.

10) Data Retention

We retain survey datasets for up to 24 months unless a longer period is required for research validity, legal, regulatory, or security reasons. Aggregated or fully de-identified results may be kept indefinitely.

11) Your Rights (POPIA)

  • Access, correction, or deletion of your personal information (subject to lawful exceptions).
  • Objection to certain processing and withdrawal of consent (does not affect prior lawful processing).
  • Lodging a complaint with the Information Regulator (South Africa).

12) Acceptable Use

  • No unlawful, infringing, hateful, or harmful content or conduct.
  • No reverse engineering, scraping, or security interference.
  • No unauthorised access to data that is not intended for you.

13) Intellectual Property

The App (excluding User Content) including software, design, logos, and content is the intellectual property of CSPI (Pty) Ltd or its licensors. No rights are granted except as expressly stated in these Terms.

14) Warranties & Disclaimer

The App is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant the App will be uninterrupted, secure, or error-free.

15) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or revenue, arising from or relating to the App. Our aggregate liability for all claims is limited to ZAR 1,000.

16) Indemnity

You agree to indemnify and hold CSPI (Pty) Ltd harmless from claims arising out of your breach of these Terms or misuse of the App.

17) Suspension & Termination

We may suspend or terminate access immediately if you breach these Terms, for security reasons, or if required by law. You may stop using the App at any time. Upon termination, your licence ends; sections relating to IP, liability, and indemnity survive.

18) Changes to Terms or App

We may modify these Terms or the App. Material changes will be notified by in-App notice, email, or by updating the “Last updated” date. Continued use after changes means you accept the updated Terms.

19) Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. You consent to the exclusive jurisdiction of South African courts. Before litigation, parties will first attempt in good faith to resolve disputes within 30 days.
